Interpretation

When a word in these Terms begins with a capital letter, it carries the definition from this section, no matter if it is used in the singular or the plural.

Definitions

Termination ends your right to use the Service at once.

Limitation of Liability

No matter what damages you incur, the total liability of the Company and its suppliers under these Terms, and your sole remedy, is capped at what you actually paid through the Service, or at 100 USD if you made no purchase there.

As far as applicable law allows, neither the Company nor its suppliers will be liable for special, incidental, indirect or consequential damages of any kind. That includes loss of profits, data or other information, business interruption, personal injury and loss of privacy arising from or related to use of, or inability to use, the Service, any third-party software or hardware used with it, or anything else connected with these Terms. In some jurisdictions, certain warranties cannot be excluded and a consumer’s statutory rights cannot be limited, so some or all of the exclusions and limitations above may not apply to you. Even then, this section applies to the greatest extent the applicable law will enforce.

Governing Law

Severability and Waiver

Severability

Should any provision of these Terms be held invalid or unenforceable, that provision will be adjusted and interpreted to achieve its aims as far as applicable law permits, and the rest of the Terms stay fully in force.

Waiver

Unless these Terms say otherwise, a party that does not use a right or demand that an obligation be met keeps the ability to do so later. Waiving one breach also does not waive any breach that follows.

Translation Interpretation

If we offer these Terms and Conditions on the Service in another language, you accept that in a dispute the English original takes priority.

Changes to These Terms and Conditions

We may change or replace these Terms whenever we choose, at Our sole discretion. For a material revision, we will do what is reasonable to give at least 30 days’ notice before the new terms apply, and we alone decide what counts as material.
